Zoning Hearing Board Public Notice - February 06, 2019
The following meeting of the Easttown Township Zoning Hearing Board will take place at the Easttown Township Building, 566 Beaumont Road, Devon, PA 19333 on Wednesday, February 06, 2019 beginning at 7:00 p.m. prevailing time:
ZHB 583 – Waynesborough Country Club – 440 Darby Paoli Road, Paoli. (AA District TPN 55-4-2) Applicant proposes to construct an accessory building for its pool facility. A variance is requested from Section 455-14.A. to allow an accessory building height of 27 feet where the maximum height allowed is 20 feet or in the alternative a variance from Section 455-35.A to allow the proposed accessory building to be considered a second principal building where only one principal building is allowed, and any other relief that may be deemed necessary by the Zoning Hearing Board.
ZHB 584 – Centric Bank – 105 Lancaster Avenue, Devon. (PBO District TPN 55-3E-92) The Applicant proposes to install a drive-through service window for a proposed bank. A variance is requested from Section 455-56.B to allow drive-through service on a lot with less than ½ acre of Net Lot Area where the minimum Net Lot Area required is ½ acre, and any other relief that may be deemed necessary by the Zoning Hearing Board.

Please be advised that on Monday, February 4, 2019 at 7:00 P.M. prevailing time, at the Easttown Township Building, 566 Beaumont Road, Devon, PA 19333, the Easttown Township Board of Supervisors will conduct a public hearing to consider and immediately thereafter during its regular meeting decide whether or not to enact an Ordinance, the title and summary of the principal provisions of which are as follows: AN ORDINANCE OF EASTTOWN TOWNSHIP, CHESTER COUNTY, PENNSYLVANIA, AMENDING THE CODE OF THE TOWNSHIP OF EASTTOWN, AS AMENDED, AT §400-41.B TO AMEND THE SIDEWALK WIDTH; §400-51 to create a new subsection addressing driveways in the rights-of-way; §447-3 to add a definition for small wireless facilities; §§447-5.A(19), 447-6.B(3), 447-6.C(3) to address timing for approvals; §447-6.B(4) to modify fees; §455-28.B TO AMEND THE MAXIMUM IMPERVIOUS SURFACE REQUIREMENT; §455-44.B(1) TO AMEND THE CLASS I RESOURCE DEFINITION; CREATING A NEW §455-72.3 TO PROVIDE FOR SHORT TERM RENTALS; §455-74.A.7 TO PROVIDE CLARIFICATION REGARDING THE USE OF PARKING SPACES; ARTICLE XI, SIGNS, TO DELETE THE ARTICLE IN ITS ENTIRETY AND REPLACE IT WITH NEW ARTICLE XI, SIGNS, WHICH PROVIDES FOR PURPOSE, INTENT, CONFORMANCE, PROHIBITED SIGNS, AUTHORIZED SIGNS, SPECIFIC SIGN REGULATIONS, SUPPLEMENTAL CRITERIA, NONCONFORMING SIGNS, SIGN PERMITS, STRUCTURAL REQUIREMENTS, AND MAINTENANCE; §455-132 BY DELETING DEFINITIONS AND ADDING A DEFINITION FOR SHORT TERM RENTAL; Chapter A490, “Standard Construction and Material Specifications for Public Improvements,” A490 Attachment 1, dETAILS 5, 6, 8b, 8c AND 8d; Ordinance 428-17 at §3.04.C to adjust the fee; AND OTHER MISCELLANEOUS PROVISIONS CONTAINED HEREIN. Section 1 clarifies sidewalk width. Section 2 creates a new subsection addressing driveways in the rights-of-way. Section 3 adds a new definition for small wireless facilities. Section 4 modifies the time period for approval for small wireless facilities. Section 5 modifies the time period for approval of small wireless facilities. Section 6 modifies permit fees. Section 7 modifies the time period for approval for small wireless facilities. Section 8 amends the impervious surface coverage provisions. Section 9 clarifies the definition of a Class 1 structure. Section 10 provides for short term rental regulations. Section 11 addresses vehicle inventory storage. Section 12 creates new sign regulations. Section 13 adds a definition for short term rental. Section 14 modifies A490 Attachment 1. Section 15 modifies the Floodplain Permit application fee. Section 16 provides for repealer. Section 17 provides for severability if any sentence, clause, section or part of this Ordinance is held to be unconstitutional, illegal or otherwise invalid. Section 18 permits General Code to make nonsubstantive formatting and numbering changes. Section 19 provides for the Ordinance to become effective five (5) days after enactment as provided by law. Complete copies of the proposed Ordinance may be examined and copies obtained (for the cost of reproducing same) at the Township Building, Monday through Friday, 8:00 A.M. to 4:30 P.M., 566 Beaumont Road, Devon, Pennsylvania. The Township is proposing various amendments to the Township Code. If adopted, the amendments will:
- Increase the minimum width of sidewalks to 4 feet for consistency with the Americans with Disabilities Act requirements.
- Align the maximum allowable impervious surfaces for the Lot Averaging Design Option with the underlying Zoning District’s maximum allowable impervious surface.
- Establish deadlines for approving wireless communications facility applications for consistency with a recent Federal Communications Commission Order.
- Update the 2001 Comprehensive Plan reference to 2018 Comprehensive Plan for purposes of regulating the demolition of identified historic resources.
- Add new provisions to regulate short-term rentals, such as VRBO and Airbnb.
- Remove language referring to sign content for consistency with a recent United States Supreme Court ruling.
The draft amending ordinance was recommended to the Board of Supervisors by the Planning Commission at its January 04, 2019 public meeting.
